Greek Law

This paper explores the principles underlying decisions to inscribe Athenian laws and decrees on stone, finding (against a recent paper by Michael Osborne) that many laws and decrees were not inscribed, including those of ephemeral significance. The basis of the paper is a comparative analysis of the inscribed record of 352/1-322/1 BC and the literary record of decrees proposed by Demosthenes, which extends across the same time period. It finds that three main criteria were relevant to decisions to inscribe: durability of intention; the intention to deliver a message; and religious content. The effect of the establishment of the state archive of papyrus copies of laws and decrees at the end of the fifth century is explored, and the existence of the archive identified tentatively as a factor, alongside others, explaining the very small number of extant inscribed laws from the fourth-century democracy (ca. 12) in comparison with the number of decrees (ca. 550-600).

The legislator, during the last reform of family law in Greece, in 1983, introduced joint physical custody of parents for all children. The court would decide on everything if the parents disagreed, both in the marriage and during the separation or divorce. The judges stubbornly refused to deal with the child rearing and therefore a divergent jurisprudence arose around the best interests of the child: in its name, the judge presumably removes custody from capable and good parents while refusing to do so for incompetent and bad parents. Social services do not exist, the courts just issue a decision meanwhile there is no mean of direct enforcement of such a decision. Parental alienation and emotional abuse is met in the Court’s decisions. Judges continue to refuse taking any action and questioning their jurisprudential custom. Instead of protecting children and parents, the legal system protects the civil code. However, the challenge of raising a child belongs to the parents and not to the judge. Facing Family Violence and Parental Alienation in Greece is not possible without the introduction of shared parenting, including the legal presumption of shared parenting.

In Writing Authority, Hawke argues that the rapidly changing political and economic landscape of early Greece prompted elites to begin committing laws to written form. The emergence of the polis and its institutions, the demographic growth of Greece, the development of market forces and the commoditization of wealth, all presented new challenges and difficulties for the Greeks of the eighth and seventh centuries B.C.E. Hawke contends that no one felt the attendant anxieties of these changes more acutely than the leading members of early Greek communities—they confronted regulating their intense competition for status and power in an environment where traditional sources of authority, such as Homeric epic, offered no ready solutions for problems arising from the transformation of Greek society. Greek elites enshrined in writing rules aimed at stabilizing their relationships with one another and, by extension, their communities.

Challenging both established and emerging orthodoxies about the appearance of written law in ancient Greece, Writing Authority questions the importance of a popular or communal role in the earliest Greek legislation. Approaches from anthropology, legal studies, and sociology are used to situate the emergence of Greek law in the broader context of Greek legal culture in the eighth through early sixth centuries B.C.E. as Hawke describes in rich detail the legal culture of Homer’s world, considers the impact of literacy on Greek attitudes about law and authority and its practical consequences for the governing of the Greek polis, and examines the effects of the tumultuous changes in Archaic Greece on the leading members of Greek communities. The result is a compelling monograph that provides an exhaustive and nuanced history of earliest Greek law and the motivations of the elites that brought it into being. It will be of interest to scholars of Greek history, classicists, and early legal historians.

This is the first commentary in Italian on Lysias' speech 25. The Greek text reproduces that oxoniensis of Ch. Carey (2007), from which it departs in a few places. In the general introduction (pp. 9-48), some fundamental questions are first dealt with: the speech's title, legal context, dating, fictititious or authentic charachter. The second part initially focuses on the modern reception of this speech in order to enlighten the biases against Lysias in modern scholarship, which only a different comprehension of the nature of Athenian law system, given by anthropology, can remove. Eventually an original interpretation of this text is offered as a selected and ideologically oriented reconstruction of recent events of Athenian history. The commentary (pp. 66-94) discusses the linguistic and rhetorical aspects of this speech, such as, e. g., the use of argumentum e contrario and the reductio ad absurdum, it also addresses legal and historical issues, such as, e. g., the discussed identification of the accusators, the so-called 'sykophants', with little known personalities, mentioned in other sources.

Η αύξηση του µετοχικού κεφαλαίου αποτελεί τον προσφορότερο τρόπο χρηµατοδότησης της ανώνυµης εταιρίας αντί της προσφυγής αυτής στο τραπεζικό δανεισµό. In the fifth book of the Nicomachean Ethics, Aristotle
describes the synallagma as an economic relationship always
grounded on a genetic inequality, whether the parties have reached
a previous agreement or not. Moreover, it is described as the main item affected by the so-called corrective justice. Even regardless of
the problem concerning the exact time when the parties conclude
a contract according to Athenian law, the essay highlights the great
divide existing between the ethical and political conception, on the
one hand, and the rules in force during the fourth century BC, on
the other hand. The former shapes a general ‘reipersecutory
system’ that, focusing on the credit, is directed to compensate the
claimant for the loss suffered; the latter, taking no account of the
different sources of the synallgma, seems to shape a ‘penal system’
aimed at punishing the perpetrator of the injury.

Παράνομη κατακράτηση ανήλικων στην Ελλάδα. Παραβίαση του δικαιώματος συνεπιμέλειας του πατέρα. Άρνηση μητέρας να επιστρέψει με τα ανήλικα τέκνα τους στον τόπο συνήθους διαμονής τους (Σουηδία) μετά το πέρας των θερινών διακοπών τους στην Ελλάδα. Από την παράνομη κατακράτηση των τέκνων μέχρι την
υποβολή της αίτησης του πατέρα δεν μεσολάβησε διάστημα μεγαλύτερο του έτους. Ένσταση μητέρας. Η επιστροφή των τέκνων θα τα εκθέσει σε έντονη ψυχική δοκιμασία.  Εξαιρέσεις που εισάγει το άρθ. 13 ΣΧάγης 1980. Εφαρμόζονται ανεξάρτητα αν έχει ή δεν έχει παρέλθει έτος από την παράνομη μετακίνηση ή κατακράτηση. Συντρέχει σοβαρός κίνδυνος έκθεσης των τέκνων σε έντονη ψυχική δοκιμασία, λόγω παρέλευσης 4 ετών από την παράνομη κατακράτηση
και της πλήρους προσαρμογής τους στο φιλικό και κοινωνικό τους περιβάλλον. Απορρίπτει ισχυρισμό πατέρα περί λήψης κατάλληλων μέτρων αποτροπής κινδύνου έκθεσης ανήλικων τέκνων. Απορρίπτει αίτηση επιστροφής.

2. ΕφΘεσ 1905/2017
Αίτηση επιστροφής ανήλικου τέκνου, γεννημένου εκτός γάμου των γονέων του. Συνήθης διαμονή τέκνου στη Σκωτία. Παράνομη κατακράτηση τέκνου στην Ελλάδα κατά παραβίαση δικαιώματος επιμέλειας του πατέρα, το οποίο αποκτά κατά το δίκαιο της Σκωτίας με μόνη την εγγραφή του ονόματός του στη ληξιαρχική πράξη γέννησης του παιδιού. Δεν μεσολάβησε διάστημα μεγαλύτερο του έτους από την παράνομη κατακράτηση του τέκνου μέχρι την υποβολή της αίτησης του πατέρα. Ένσταση μητέρας ότι η επιστροφή του τέκνου στη Σκωτία θα τα εκθέσει σε ανεπανόρθωτη ψυχική δοκιμασία. Κρίνει ότι επιστροφή του τέκνου στη Σκωτία αντίκειται
στο αληθινό συμφέρον του λόγω ιδιαίτερα μικρής ηλικίας
και πλήρους ένταξής του στο νέο οικογενειακό και κοινωνικό περιβάλλον του. Απορρίπτει αίτηση.

3. ΕφΘεσ 733/2017
Αίτηση επιστροφής τέκνου στη Γερμανία. Μετακινήθηκε στην Ελλάδα. Από κοινού άσκηση της επιμέλειας ανήλικου τέκνου. Δεν συντρέχει περίπτωση παράνομης μετακίνησης ή παράνομης κατακράτησης. Το
παιδί μετακνήθηκε από τη μητέρα και παρέμεινε στην Ελλάδα με τη σύμφωνη γνώμη του πατέρα. Συντρέχουν περιστάσεις που δικαιολογούν την άρνηση επιστροφής του τέκνου στη Γερμανία. Πλήρης ενσωμάτωση του παιδιού στην Ελλάδα. Τυχόν επιστροφή του θα το εκθέσει σε ψυχική δοκιμασία.

4. ΜονΠρΘεσ 5777/2019
Αγωγή πατέρα περί μεταρρύθμισης απόφασης ανάθεσης αποκλειστικής επιμέλειας κοινού ανήλικου τέκνου στη μητέρα
λόγω ουσιώδους μεταβολής συνθηκών. Μετοίκιση μητέρας με ανήλικο τέκνο της στις ΗΠΑ. Ισχυρισμός περί κακής άσκησης δικαιώματος επιμέλειας. Η μετοίκιση δεν αποτελεί κακή άσκηση δικαιώματος επιμέλειας, αλλά ενάσκηση δικαιώματος καθορισμού τόπου διαμονής του τέκνου. Στενός σύνδεσμος τέκνου με μητέρα και πλήρης προσαρμογή του στο νέο κοινωνικό και οικογενειακό του περιβάλλον. Προς το συμφέρον του η εξακολούθηση άσκησης αποκλειστικής επιμέλειας από τη μητέρα.

5. ΜονΠρΘεσ 7151/2019
Αγωγή χρηματικής ικανοποίησης λόγω ηθικής βλάβης εξαιτίας
στέρησης δικαιώματος επικοινωνίας πατέρα με το ανήλικο
τέκνο του. Μετοικεσία μητέρας με τέκνο στις ΗΠΑ. Αποκλειστική επιμέλεια τέκνου από μητέρα. Είχε δικαίωμα καθορισμού τόπου διαμονής. Καταχρηστική άσκηση. Οδήγησε στη ματαίωση του δικαιώματος επικοινωνίας του πατέρα. Δέχεται αγωγή.

Η παρούσα μονογραφία παρουσιάζει και αναλύει τα νομοθετικά και ερμηνευτικά ζητήματα του ν. 4601/2019 για τους εταιρικούς μετασχηματισμούς (μετατροπή, συγχώνευση και διάσπαση επιχείρησης). Ειδικότερα, αντιμετωπίζει τα κυρίαρχα προβλήματα της διεύρυνσης του πεδίου εφαρμογής του ν. 4601/19 στις επιχειρήσεις, που έχουν οικονομική οργάνωση και της έκτασης των πρόσθετων και συμπληρωματικών ρυθμίσεων μέσω εταιρικών/ εξωεταιρικών διαμορφώσεων και ερευνά το επιτρεπτό αυτών ως συναλλακτικά μορφώματα υπό το ν.4601/19. Τα προβλήματα αυτά οφείλονται σε νομοθετικές ασάφειες και αντινομίες σχετικά με τη ρύθμιση των μετασχηματισμών και της σύγκρουσης του εταιρικού δικαίου με το φορολογικό, ζητήματα τα οποία εντοπίζει και αποπειράται να αποσαφηνίσει ο Συγγραφέας.
This monograph deals with various types of Business Transformations (conversion, merger, division of a company, hive-off of various divisions), which were introduced into Greek law with the Law 4601/19, in fragments from the German law on Business Transformations (UmwG) and from the incorporation of the EU Directive 2017/1132 / EC of the European Parliament of 14 June 2017.

Πρόκειται για την δίκη της υπόθεσης υπ’ αριθμόν 610/2018 ενώπιον του Συμβουλίου της Επικρατείας. Αντικείμενό της είναι οι περιορισμοί στην άσκηση του δικαιώματος του πληροφορεῖν και του δικαιώματος στην πληροφόρηση στο μέτρο που μπορούν να δικαιολογηθούν για την προστασία της αξίας των ανθρώπων, της προσωπικότητας των ατόμων και της ερωτικής τους ζωής και δη της επιλογής του γενετήσιου προσανατολισμού τους.

The paper addresses the issue of “animal rights” as proposed by Nussbaum in Chapter 6 of "Frontiers of Justice: Disability, Nationality, Species Membership". The recent Greek legislation on the protection of animals is analyzed according to Nussbaum’s “capabilities approach” concluding that, despite the evolution on the protection of animals, it will take a long time before the recognition of the notion of “animal rights” by the law.

This article discusses the concept of ownership of land in the Late Babylonian period, especially the Hellenistic period. All kinds of transaction concerning land ownership are discussed, such as contracts of sale, lease, pledge, donation and quitclaims. Attention is paid to different legal formularies and the ways in which ownership was protected. The article challenges the accepted opinion, expressed by Koschaker, Petschow and Cardascia, that the Babylonians lacked a concept of ownership that knew the distinction between ownership as ultimate right (in Latin dominium) and actual possession or holding (in Latin possessio and detentio). Koshaker and Petschow argued for a Babylonian concept of  “divided ownership” of e.g. lessor and lessee of land and Cardascia calls pledge a “conditional alienation” and lease a “temporal alienation”. In my view the Roman distinction between ownership as highest and ultimate right and actual possession, though not identical, is closer to the Babylonian situation.
Another point at issue is the status of temple land and royal land, that was in the possession of individuals, could be sold and leased, yet remained in ownership of the temple or palace (bIt ritti).

At the end of the article ten cuneiform texts are presented in transcription, translation and brief commentary. One of these texts is a very important tablet, discovered already the beginning of the 19th century and copied by Carl Bellino by c. 1818. It was published by Robert Ker Porter in 1822. It was one of the first published tablets, copied and published in a time when the cuneiform script was not yet deciphered. Yet the copy is quite good and readable. I first edited this tablet in my dissertation, where I reproduced Bellino’s copy op p. viii and a transliteration and Dutch translation in the Appendix, text 5, p. 202-11. Both authors suggested improved readings which I shall present here and I shall present a new English translation of lines 4-15, slightly differing from Joannès’s and Jursa’s (esp. line 10).

9. Read [i-(te)-ri-i]š instead of [iš-ku]n; Joannès reads ina áš-bi instead of ina qí-bi, but Bellino’s copy has a very clear qí (KI), so I shall not follow him in this. He reads the personal name mPar-ta-ri-ih?-li-su as mtu!?-ri-il!-li-su (Troilos?). The copy, however, has a clear par-ta. The reading of the first sign, par (UD, tú), is a mere guess. The reading –ut-  is a good alternative. The sign read as ih or il is difficult to interpret. Collation (1984) did not help. It seems indeed that a Greek name is at issue, ending on –lēs, -lios or –klēs perhaps.
10. Read [lúGAL] É LUGAL (Jursa) and ig!-re-e’ instead of EN re-‘i (Joannès and Jursa), from the verb gerû, ‘to start a lawsuit’. See CAD G, p. 62, s.v. gerû, 1 b 3’: dīna gerû. Certainly correct. It is uncertain whether the phrase mišil ... našatat?, “half of the barley which returns from the land, the property of Shamash, is (to be) brought(?) to the royal treasury”, is the result of the verdict (so Jursa), or the reason to start the lawsuit. I opt hesitatingly for the latter option: I suspect that the legal dispute originated in the fact that suddenly in year 9 the chief of the royal treasury requisitioned half of the yield of the entire estate of the Shamash temple.
11. Joannès reads ta-tu-ru instead of ta-tur-ru, but this is erroneous. Taturru is the present tense, which means that the barley is not harvested yet or is in the process of being harvested. Jursa reads na-šá-ti?! sup. ras. instead of na-šá-tat?; both readings problematic. Collation did not help. I assume that the form is a fem. stative of našû. Note that taturru is also feminine . The subject, uțțatu, “barley”, is feminine.
13. Read mu-šu-ur instead of  MU-šu lu (Joannès and Jursa). Certainly correct. From the verb uššuru (wuššuru, muššuru), “to let go; to release; the hand over; to exempt, remit debts, annul obligations”; cf. CAD U and W, s.v. uššuru, p. 310-325. It is probably a stative: muššur ; cf. undašar for undaššar in line 13.

Both Joannès and Jursa read É LUGAL TIN.TIR.KI as Bīt šar Bābili, and do not interpret it as Treasury (Bīt šarri =lit.  ‘house of the king’, but always ‘royal office’, ‘royal treasury’ or ‘royal estate’) of Babylon (TIN.TIR.KI), but as the locality with the name Bīt šarri Bābili (mostly written, however, with the determinative for ‘city’ URU), a locality close to Babylon. N.B.: the royal treasury is mentioned in line 10! If so, Iltalimatu has nothing to do with the royal treasury of Babylon and is no more than some city governor who accidentally had rented an estate belonging to the temple of Shamash.

This document is a verdict concerning a legal conflict between two parties, namely Ebabbar, the temple of the god Shamash in either Sippar or Larsa, and a certain Iltalimatu, the governor of Bit-šar-Babili (= a settlement at the edge of the city of Babylon, perhaps the summer palace of Babylon). Apparently some arable land, belonging to the Ebabbar had become at the disposal of Iltalimatu and he cultivated it jointly with the temple, which probably meant that the profit should be divided, half would go to the temple, half to Iltalimatu. The conflict seems to concern the fact that half of the harvest was requisitioned by the state (represented by Partarihlisu), so that Iltalimatu could not pay half of the harvest to the temple (his sutu, his rent). Now Partarihlisu seems to have ordered or advised a lawsuit (or perhaps better a settlement), so that the mutual claims by temple and Iltalimatu were rescinded: Iltalimatu relinquishes his right to cultivate the temple land and at the same time is freed from the obligation to pay his rent to the temple. One should note that it was during or briefly after the Babylonian War between Antigonus and Seleucus (311-308) when the grain prices were extremely high.  Now the result of this lawsuit is: half of the yield of year 9 (308-7 BC) goes to the royal treasury and the contract between Iltalimatu and the temple is dissolved: the temple is granted ownership rights of the arable land and Iltalimatu is freed from paying rent to the temple in perpetuity.

This paper studies the way litigants in viewed the verdicts given by Athenian courts and is based on a catalogue of all cases mention in the forensic speeches of the Attic Orators. It shows that the Athenian believed that accusers won convictions when the proved the legal charges in the plaint and lost when they could not prove them. Litigants thought that unjust verdicts occurred because of false testimony or procedural violations. The Athenians did not view their trials as feuds in which the courts regulated enmity or contests of prestige among the elite. The function of the courts was to enforce the substantive rules contained in statutes. This essay has now appeared in The Use and Abuse of Law in the Athenian Lawcourts edited by C. Carey et alii (Brill; Leiden 2018): 42-74.

This chapter explores the development of ideas about legislation and legislative procedures in ancient Athens. It isolates an ideology of legislation that mistrusted legal change, and that came into conflict with democratic ideas and practices. It then discusses the creation of nomothesia procedures at the end of the fifth century BCE that reconciled the need for legal change with that for consistent and stable laws, and follows the workings of these procedures throughout the fourth century BCE.

Es wird argumentiert, dass wir diese Quelle vor dem Hintergrund der in den frühen Epen reflektierten frühstaatlichen Szenarien und der spezifischen sozio-politischen Umstände einer kretischen Polis interpretieren sollten. Hierbei wird zweierlei deutlich: Die Regelung reflektiert einen historischen Zustand, in dem aus der Notwendigkeit des inneren Friedens die Konkurrenz der Aristoi kanalisiert und beschränkt wurde. Zudem wurden wegen der zunehmenden Komplexität des gesellschaftlichen Lebens Aufgabenbereiche in Form von Ämtern institutionalisiert. Für deren Ausübung wurden Regeln eingeführt, um die noch nicht gefestigten Übergänge zwischen sozial gewachsenen und durch Institutionalisierung generierten Prominenzrollen zu definieren und zu wahren.

Greek scholars have produced a vast body of evidence bearing on nuptial practices that has yet to be mined by a professional economist. By standing on their shoulders, the author proposes and tests radically new interpretations of three important status groups in Greek history: the pallakē, the hetaira, and the nothos. It is argued that legitimate marriage—that is, “marriage by loan of the bride to the groom”—was not the only form of legal marriage in classical Athens and the ancient Greek world generally. Pallakia—that is, “marriage by sale of the bride to the groom”— also was legally recognized. The pallakē-wifeship transaction is a sale into slavery with a restrictive covenant mandating the employment of the sold woman as a wife. The book proposes and tests the hypothesis that the likelihood of bride sale rises with increases in the distance between the ancestral residence of the groom and the father’s household. The “bastard” (nothoi) children of pallakai lacked the legal right to inherit from their fathers but were routinely eligible for Athenian citizenship.. It is argued that the basic social meaning of hetaira (“companion”) is not “prostitute”/”courtesan” but “single woman”—that is, woman legally recognized as being under her own authority (kuria). The defensive adaptation of single women is reflected in Greek myth and social practice by their grouping into packs, most famously the Daniads and Amazons.

A perspective on the nature of the Roman legal order in the provinces and the status of local laws and practices under Roman rule. These questions are explored through a series of case studies from Roman Egypt, including the well-known petition of Dionysia (P. Oxy. II 237).

Οι εκδόσεις «Νομική Βιβλιοθήκη» εξέδωσαν πρόσφατα ένα ακόμα βιβλίο του καθηγητή Παναγιώτη Παναγιώτου, που φέρει τον τίτλο, «Εμπορικό Δίκαιο», στο οποίο ο συγγραφέας, με τη γνωστή πληθωρική επιστημονική, αναλυτική και κριτική ικανότητα, που διαθέτει, παραθέτει, επεξεργασμένη, με τρόπο συνεκτικό και περιεκτικό, όλη την ύλη του κλασικού Εμπορικού Δικαίου. Η βαθειά νομική του παιδεία, έκδηλη, τόσο στο λοιπό εκτεταμένο επιστημονικό έργο του, συγκροτούμενο από πολλές μελέτες, άρθρα, γνωμοδοτήσεις, βιβλία, όσο και στο εύρος της πανεπιστημιακής του διδασκαλίας, απετέλεσε το θεμέλιο και του τελευταίου αυτού έργου του και το εχέγγυο, συνάμα, της βαρύτητας των αναφορών του.  Αποτελεί  ένα εξαίρετο ώριμο επιστημονικό έργο έμπειρου συγγραφέα, με πλούσια τεκμηρίωση, που μπορεί να συμβάλλει ουσιαστικά στην προσπάθεια κάθε ενδιαφερόμενου να προσεγγίσει το σύγχρονο εμπορικό δίκαιο  και να εφαρμόσει τις διατάξεις του στην πράξη.  Στο επίτομο αυτό έργο, αφενός μεν αντικατοπτρίζεται η σημερινή πραγματικότητα στο εμπορικό δίκαιο, αφετέρου δε διατυπώνονται από τον συγγραφέα ιδέες για την αναγκαία μετεξέλιξη του.

Η κινηματογραφική απόδοση της «δικαιοσύνης» και του ηρωισμού χαράσσει με ιδιαίτερη ευκολία τις συνειδήσεις μας και στην αντίθετη όχθη η, τεθειμένων διαδικασιών, θανατική ποινή ξεσηκώνει την αγανάκτηση και οργή, αντίθεση που προσωπικά την αναγάγω στην ολοένα μειούμενη ταύτιση των κοινωνών προς τα κυβερνητικά όργανα και στην έλλειψη ουσιαστικής κατανόησης της αρχής της πλειοψηφίας και της ελευθερίας της κομματικής δράσεως.

Film protection by copyright has both advantages and disadvantages. This article deals with the legal protection of films in Greece and the United States of America. The aim is to demonstrate the differences between the laws of these two countries by examining specific issues concerning the protection of films, such as protection of fictional characters and plots in filmic texts.

Η τεχνολογία του Blockchain αναμένεται να φέρει επανάσταση στο τρόπο διενέργειας των συναλλαγών στο εγγύς μέλλον –μια επανάσταση, που συγκρίνεται από πολλούς με αυτή που έφερε το διαδίκτυο πριν από περίπου τρεις δεκαετίες. Παρόλο που η πιο γνωστή εφαρμογή της παραμένει έως σήμερα αυτή στο πλαίσιο των κρυπτονομισμάτων, το Blockchain χρησιμοποιείται ήδη με σχετική επιτυχία σε πολλούς τομείς. Χάρις στην αποκεντρωμένη και κατανεμημένη δομή του, η τεχνολογία αυτή υπόσχεται την εξάλειψη των μεσαζόντων κατά την διενέργεια των συναλλαγών, καθώς και επαρκή ασφάλεια των δεδομένων των εγγραφών σε αυτό. 
Η παρούσα μελέτη εξετάζει την τεχνολογική δομή, καθώς και τα βασικά χαρακτηριστικά των πλατφορμών Βlockchain, με βάση τα διδάγματα από την μέχρι τώρα εφαρμογή του.  Στην συνέχεια, αναλύονται οι βασικές χρήσεις που μπορεί να έχει αυτή η νέα τεχνολογία στην καθημερινότητα, πέραν από την ήδη γνωστή λειτουργία της στο πλαίσιο των κρυπτονομισμάτων, καθώς και οι νομοθετικές εξελίξεις γύρω από αυτήν, ιδίως στο πλαίσιο της Ευρωπαϊκής Ένωσης. Ιδιαίτερη έμφαση δίδεται στις νομικές προκλήσεις που καλείται να αντιμετωπίσει το Blockchain, σχετικά με την συμβατότητά με το υφιστάμενο νομικό σύστημα και την ανάγκη νομοθετικής παρέμβασης.  Με άλλα λόγια, τίθεται το ερώτημα: πόσο εύκολα μπορεί άραγε, να δεχθεί η έννομη τάξη την καινοφανή αυτή τεχνολογία σήμερα;

Blockchain technology is expected revolutionize the way transactions work in the near future -a revolution that for many is comparable with the one brought by the Internet about three decades ago. Although its best-known application so far are cryptocurrencies, Blockchain is already being used successfully in many fields. Thanks to its decentralized and distributed structure, this technology promises the elimination of intermediaries in conducting transactions, as well as the adequate security of the data.
This study examines the technological structure, as well as the key features of the Blockchain platforms, based on the lessons learnt from its implementation thus far. It analyzes the possible basic uses of this new technology in everyday life, beyond its already well-known function in cryptocurrencies, as well as the legislative developments around it, especially within the European Union. Particular emphasis is placed on the legal challenges faced by Blockchain regarding its compatibility with the existing legal system and the need for legislative intervention. In other words, it raises the question: how easily could the legal system accept this new technology and its implementations?
